Residencia after Brexit
The post-Brexit Spanish residency pathway for UK citizens
In this guide
Overview — UK citizens after Brexit
UK citizens are now treated as third-country nationals for Spanish residency purposes since the end of the post-Brexit transition period. Long-term residency in Spain (over 90 days in any 180) requires either a residency authorisation issued by the Spanish consulate before arrival, or validation of a long-stay visa within the first month after arrival.
Pre-Brexit UK residents in Spain are protected under the Withdrawal Agreement and have a streamlined route to retain their pre-Brexit rights via the Withdrawal Agreement TIE.
Visa categories — choosing the right pathway
Non-lucrative visa (visado de residencia no lucrativa): the most common UK retirement path. Requires proof of sufficient passive income (typically €27,000+ per year for the principal applicant, more for dependents — based on 400% of the IPREM annual benchmark), proof of accommodation, proof of healthcare cover (private until SSN eligibility), commitment not to work in Spain. Issued for 1 year initially, renewable.
Work visa (visado de trabajo): the Spanish employer files paperwork (a permiso de trabajo from the Subdelegación del Gobierno) before you arrive. Standard third-country pathway.
Self-employed visa (cuenta propia): requires demonstrating viable business income, registration with the relevant Spanish tax and social security systems. Most paperwork-heavy pathway.
Family-reunification visa (reagrupación familiar): for UK spouses of Spanish or EU citizens. Requires proof of relationship and the partner's Spanish residency.
Student visa, golden visa (residencia por inversión — for property purchases over €500,000 or other qualifying investments), and digital nomad visa (visado para teletrabajo de carácter internacional, introduced 2023) are alternative pathways for specific circumstances.
Application process — the practical steps
For most UK citizens moving permanently, the right sequence is: (1) apply for the long-stay visa at the Spanish consulate in the UK before travelling — typically a 2-3 month process with in-person appointment, biometrics, document submission. (2) Travel to Spain with the long-stay visa stamped in your passport. (3) Within 30 days of arrival, attend the Oficina de Extranjería for residencia validation — the visa is exchanged for a residency authorisation and you receive an appointment for TIE biometrics. (4) Attend the TIE biometrics appointment at the Comisaría de Policía Nacional. (5) Collect the TIE physical card 4-6 weeks later.
Renewal: the first renewal is typically straightforward. After 5 years of continuous residence, you can apply for the residencia de larga duración (long-term residence permit, similar to UK indefinite leave to remain).
Common issues
Income threshold for non-lucrative visa: the €27,000 annual figure is strict; demonstrate stable rather than just sufficient income across 12 months of statements. Pension statements, investment income evidence, savings documentation all help.
Healthcare cover during the SSN gap: budget for private Spanish or international health insurance for the first 3-6 months from arrival.
TIE collection delays: the TIE card collection typically takes 4-6 weeks after biometrics. Until you have the physical card, the residencia authorisation paper is what you carry as proof.
Catalan / Basque / Galician regional addons: in Catalonia, the Basque Country, and Galicia, additional regional-language paperwork may apply at the local level. Bilingual gestores help.
